Call to Order
Judge Lawler called the meeting to order at 8:05 am.

Board Business
1. Approval of Minutes
A motion was made and seconded to approve the minutes as presented for the Board meeting held on April 11, 2011. The motion passed.[1]

2. Chair Report
Judge Lawler reported on the following topics:
a.     Legislative Update: SHB 1053 which calls for periodic reports, expiring letters, mandatory lay guardian training, and fees charged for annual accounts was delivered to the governor for signature.  The governor has been requested to veto the user fee section of the bill by the SCJA and the WSBA. ESSB 5740 has been re-introduced in the special session, but the House and the Senate have not agreed to each other’s changes.
 
b.     Long Term Planning Meeting. Reservations for hotel rooms will be made at the Red Lion in Olympia for the June 17 and June 18 Board meeting.
 
3. Committee Reports
SOP Committee: 
a.     CPGB NO. 2011-011, this is an Agreement Regarding Discipline resulting from the guardian having multiple late filings when re-audited. The guardian will agree to an admonishment and to pay for a case monitor.  A question was raised whether the fact that the audit was not a surprise audit was an aggravating factor, but it has not been a factor in other agreements resulting from the DR 520 audit.
 
b.     CPGB No. 2010-004, this is an Agreement Regarding Discipline resulting from several cases in which the guardian failed to send in updates about the financial status of clients. There was no harm to the clients. The guardian agrees to accept an admonishment.
 
Regulations Committee: 
The committee chair reported that the reorganization and re-numbering of some of the existing Standards of Practice were not approved for all of the SOPs at the last meeting of the Board. Motion made and seconded to approve the re-organization and re-numbering of the Standards of Practice that are to be effective January 31, 2012 and are in the Board’s materials for this meeting. There was no discussion. The Chair thanked the Regulations Committee for its hard work on these revisions. Motion passed.
 
Education Committee
a.     Testing: There was a discussion at the committee’s last meeting with the Center for Guardianship Certification about testing and developing a test that would be specific for Washington guardians. The Committee has developed an outline of a process to follow to address the testing issue and will report by year’s end.
 
b.     Education regulations 203.2 and 208.1 have been posted and have received no comments. A motion was made and seconded to amend regulation 203.2 and 208.1 as follows:  
 
Regulation 203.2 A credit shall be awarded for each hour actually spent by an active Guardian or an inactive guardian who is planning to become active within the next 12 months in attendance at an approved education activity.
 
Regulation 208.1 Compliance Report. Within 30 days from the end of the preceding reporting period, each Guardian shall submit an affidavit to the Committee, at the AOC, setting forth all information required by the Affidavit Reporting CEUs concerning such active Guardian’s completion of approved continuing education during the preceding reporting period. Such affidavit shall also contain a report of “carryover” credits, if any, as delineated in Regulation 202.
 
No discussion. The motion passed.
 
4. Executive Session
The Board adjourned to executive session. 

5. Open Session
The Board reconvened in open session and took the following actions:

a.         Motion made and seconded to adopt the Agreement Regarding Discipline in CPGB No. 2011-011. Motion passed.
 
b.         Motion made and seconded to adopt the Agreement Regarding Discipline in CPGB No. 2010-004. Motion passed with one abstention.
 
c.     Motion made and seconded for conditional approval[2] of the following application for certification. Motion passed:

d.     Motion made and seconded for conditional approval of the following application for certification. Motion passed.

Adjourn
Judge Lawler noted the next meeting will be on June 17 and June 18 and will be at the Red Lion Hotel in Olympia.  Judge Lawler adjourned the meeting at approximately 8:45 am.
