Call to Order:

Judge Hogan called the meeting to order.

Board Minutes:  The draft December 12, 2005 minutes were approved.

Chair Report:  Judge Hogan informed that committee about the articles in the LA Times regarding guardianship, and the LA Times public records request.  She noted that guardians would be given notice of the request.  In addition, she stated that regulations are being reviewed.

Vice-Chair Report:  Commissioner Aronow shared that his discussion would be handled in the Committee Reports.

Suzanne Thompson Wininger delivered a presentation on Adult Protective Services (APS) entitled:  Authority and Limitations; Who does APS Serve?  She explained what is considered abuse and the types of abuse such as; physical, sexual, mental exploitation, abandonment, financial exploitation, neglect, and self neglect.

The Board went into executive session.

The Board went back into open session.

Committee Reports:

Certification Committee:  The language of the individual and agency applications should be modified to require disclosure from applicants of a final order of protection for abuse or neglect of a vulnerable child or adult.  This would not include temporary orders, and would only require reporting after a hearing has taken place.  Suzanne Thompson Wininger and Tom O’Brien will continue to work on the language and the Board will revisit this issue.

Following is the list of applicants who were reviewed for certification as professional guardians and the disposition of their applications, pending receipt of clear background checks if not received to date.

Jeffrey M. Buchan - Recommendation to approve by Certification Committee.  Motion to approve was made and seconded.  Motion carried.  Approved.

Ruth A. Drollinger - Recommendation to approve by Certification Committee.  Motion to approve was made and seconded.  Motion carried.  Approved.

Cynthia L. Hanning - Recommendation to approve by Certification Committee.  Motion to approve was made and seconded.  Tom O’Brien abstained.  Motion carried.  Approved.

Sue J. Keblusek - Recommendation to approve by Certification Committee.  Motion to approve was made and seconded.  Motion carried.  Approved.

Mary A. McHugh - Recommendation to approve by Certification Committee.  Motion to approve was made and seconded.  Suzanne Thompson Wininger abstained.  Motion carried.  Approved.

Northwestern Community Advocates - Recommendation to approve by Certification Committee.  Motion to approve was made and seconded.  Motion carried.  Approved.

Eric Utto-Galarneau - Recommendation to approve by Certification Committee.  Motion to approve was made and seconded.  Motion carried.  Approved.

Following is a list of guardians who failed to pay dues.  A motion was made and seconded to decertify these guardians.  Motion carried.  Approved

Education Committee:  The RFP for Mandatory Training was posted on the contracts page of the AOC website and the submission date was extended in consideration of holiday schedules.  All proposals were due to AOC by COB January 10, 2006.  

Ethics Committee:  Regulation 117 was entitled Financial Responsibility, but after discussion the Board decided to rename the regulation to Insurance.  The Committee decided that requiring wrongful acts insurance is not feasible at this time and the section referring to this will be deleted.  A motion was made and seconded that we adopt the new Regulation 117 and that financial responsibility be revised to the term Insurance.  Approved.

This regulation will be posted for comment and voted on at the March 13 meeting.

The Ethics Opinion on Self-nomination was discussed and the following language was added.

Payment of fees and costs of a guardianship may be allocated to the petitioner upon a finding by the Court of bad faith or other grounds.

When the certified professional guardian meets with the alleged incapacitated person, great care must be taken to avoid minimizing the seriousness of guardianship proceedings or unduly influencing the impaired person to accept appointment of a guardian.

 

This opinion has been assigned the number 2005-001.

Public Information Committee: The first draft of the 2005 Annual Report is complete and will be forwarded to Judge Hogan for review.

Rules Committee: The Rules Committee will set a date to review rules and regulations.

Standards of Practice Committee:  Currently six panels have been appointed to review grievances that are pending.

Old Business:

2006 Retreat Dates:  The tentative date for the 2006 retreat is June 9-10.

Committee Assignments: New members were asked to inform the chair of their committee choices.

New Business:

None.

Judge Hogan adjourned the meeting.
