                   DECISION ON WRITTEN STATEMENTS


     (1)  A defendant may request the Court to make a decision on
the infraction in the defendant’s absence on the basis
of the defendant’s written affidavit, on a form provided
by the court and the affidavit of the complaining officer and
witnesses. The Court’s decision shall be in writing
whether an infraction was found to have been committed and
what penalty, if any, was imposed and will be mailed to the
defendant.  (Adopted effective September 1, 2000)

     (2)  A defendant may request the Court to make a decision on a
mitigation hearing  for an infraction held via e-mail on the
basis of the defendant’s written e-mail affidavit.  The
Court’s decision may be an e-mailed response and in writing whether
an infraction  was found to have been committed and what
penalty, if any, was imposed and will be e-mailed or mailed
via post card  to the defendant.
