                         RULE 59(e)
           MOTION FOR RECONSIDERATION OR NEW TRIAL


     (1)  A motion for reconsideration and any supporting
documents shall be filed and served (with a copy delivered
to the trial Judge at the time of filing) within ten (10)
days of the entry of the order, judgment, oral opinion,
memorandum opinion, or other action of the court that is
sought to be reconsidered.

     (2)  A motion for reconsideration or for new trial
shall be submitted on briefs and affidavits only, without
oral argument, unless the trial Judge orders otherwise.

     (3)  The court shall review the motion and either deny
the motion or request counsel for the non-moving party to
respond to the motion within ten (10) days of the notice to
respond.  Thereafter, the court may request further
information or oral argument, or may decide the motion
following the ten (10) day period for response.  The court's
decision may be in the form of a final order, in which case
it shall be expressly entitled as such.
