TERMINATION OF DIVERSION AGREEMENT
(a) Petition. A Petition for Termination of a
Diversion Agreement (form JU–06.0200–WPF) shall be filed
with the clerk by the deputy prosecuting attorney. The
petition shall be accompanied by an affidavit of a probation
counselor stating the matter as required by JuCR 6.6(a) and
RCW 13.40.080(6).
(b) Scheduling of Hearing. The clerk of court shall
schedule a hearing on the daily offender calendar within 30
days of the filing of a petition to terminate a diversion
agreement. Copies of the notice and accompanying affidavit
shall be furnished to the administrative supervisor for
probation services and to the public defender along with a
notation of the scheduled hearing date. The probation
counselor shall give notice of the hearing to the juvenile
as required by RCW 13.40.080(6) in accordance with JuCR 11.2.
