                          LOCAL COURT RULE NO. 1


A Defendant charged with a criminal offense punishable by a loss of freedom
shall be scheduled for a jury trial unless specifically waived by filing a
written waiver of jury trial.

A waiver of trial by jury must be in writing.  A notice of intent to change
plea and notice of intent to amend citation/complaint may be done orally to
the clerk.

A notice of intent to plea to a lesser charge, and notice of intent to
amend shall be effective any time prior to the Friday preceding the trial
date.

Thereafter, no amendment to the citation/complaint shall be permitted
except as provided below.  A waiver of jury trial shall be effective at any
time prior to 2 days before the trial date.

An amendment to the citation/complaint, waiver of jury trial and a change
of plea to a lesser charge may be allowed upon a showing of exigent
circumstances and the payment of terms in the amount of $180.00.

A Defendant may plead guilty to the charge originally alleged at any time.
    

 


    
                         LOCAL COURT RULE NO. 2


     In all Contested Infraction hearings where an attorney has appeared
for the Defendant, the State shall be represented by an attorney from the
Prosecuting Attorney's Office, or the infraction shall be dismissed with prejudice.
    

 


    
                         LOCAL COURT RULE NO. 3
             SCHEDULING AND APPEARANCES IN TRAFFIC MATTERS


All contested traffic matters where the Defendant is represented by counsel
shall be heard on Wednesday's at 11:00 A.M. or such day as the Court directs.

No Attorney shall appear for a Defendant without first filing a Notice of
Appearance seven days before any scheduled hearing. If Defendant’s attorney fails
to so file the Court will continue the contested matter to a date available to both sides.
    

 


    
                             LOCAL COURT RULE NO. 4


All Civil Infractions, including Traffic Infractions, Criminal Citations and
Criminal Complaints shall be filed in the district in which the underlying
facts occurred to wit;

Offenses occurring in the following voting districts shall be filed in Pacific
County South District Court:

          Chinook, Ilwaco 1R, Ilwaco 2R, Ilwaco, Klipsan, Long Beach, Nahcotta,
          Naselle, Nemah, Ocean Park 1, Ocean Park 2, Oysterville, Pioneer,
          Seaview 1, Seaview 2.

Offenses occurring in the following voting districts shall be filed in Pacific
County North District Court:

          Baleville, Bay Center, Ekland Park, Frances, Menlo, North River,
          Raymond Ward 2, Raymond Ward 3, Smith Creek, South Bend 1R, South
          Bend 2R, South Fork, Willapa, Raymond Ward 1P1, Raymond Ward 1P2,
          Raymond Ward 1P3, Raymond Ward 2, Raymond Ward 3, South Bend 1,
          South Bend 2, South Bend 3.

Any Citation filed in violation of this rule may be dismissed without prejudice
or transferred without notice to the correct district.
