(Effective June 8, 2000) A court may defer findings regarding traffic infractions for up to one year and impose conditions on the DEF. During or after the deferral period if the conditions are not complied with, the DEF is found to have committed the infraction.

Issue transferred to a court in another area pursuant to IRLF 2.3.1.

Dismissed After Deferral

(Effective June 8, 2000) A court may defer findings regarding traffic infractions for up to one year and impose conditions on the DEF. At the end of the deferral period if the DEF complies, the charges are dismissed.

Deferred Finding

(Effective June 8, 2000) A court may defer findings regarding traffic infractions for up to one year and impose conditions on the DEF. At the end of the deferral period, the charges are dismissed if the DEF complies. If the DEF fails to comply, a finding of Committed After Deferral (CD) is entered.

     

DO

Dismissed Without Prejudice

Charge dismissed without prejudice. No rights or privileges of the party are waived or lost. A Dismissal Reason code is required in the F/J Reason field.

     

DW

Dismissed With Prejudice

Charge dismissed with prejudice. The rights of the parties are concluded and further proceedings are not permitted. A Dismissal Reason code is required in the F/J Reason field. An infraction not brought to hearing within the time period specified in IRLJ 2.6(e) may be dismissed with prejudice.

     

NC

Not Committed

DEF found not to have committed an infraction as charged.

     

OD ++

Other Deferral/Diversion

The court orders or allows the parties to enter into a pre-trial stipulated agreement, which imposes specific conditions on the DEF. Upon completion or adherence to the conditions, the court may dismiss or amend the charge, or the defendant may enter a response of Not Committed (NC). This is known as a deferred finding, agreed continuance, or court accepted diversion program. This code replaced "DS - Deferred Sentence" as of 11-1-1994. An Other Deferral Reason code is also required in the F/J Reason field.

     

P

Paid

DEF found to have committed the infraction as charged, pays the penalty in full and does not contest the charge nor ask for a hearing to explain. Note: This code is automatically entered on PLS when full payment is receipted on RCP with a Trans Type of PP (Penalty Payment).

Court finds probable cause exists to believe the accused committed the offense charged and binds the charge over to superior court pursuant to CrRLJ 3.2.1. This code is valid only with a PC or CF charge.

DEF found guilty of the criminal offense charged after an other deferral/diversion program was revoked OR the program was completed and the DEF pled guilty to a reduced or amended charge. This code replaced "GS - Guilty, Deferred Sentence Revoked" as of 4-1-1994.

DEF found guilty of the domestic violence (DV) criminal offense charged where 1) the DV aspect of the charge was pled in the charging document and 2) a judgment of guilty is entered on the charge with a specific finding made that the domestic violence was pled and proved.

Guilty – DV Pled and Proved Revoked Deferral/DP

Other Deferral or Diversion

The court orders or allows the parties to enter into a stipulated agreement, which imposes specific conditions on the DEF. Upon completion or adherence to the conditions, the court may dismiss or amend the charge, or the DEF may enter a plea of not guilty (NG). This is known as a pre-trial deferred finding, agreed continuance, Stipulation on Order of Continuance (SOC), or court accepted diversion program. This code replaced "DS - Deferred Sentence" as of 11-1-1994. An Other Deferral Reason code is also required in the F/J Reason field.

Note: When a Guilty Plea has been entered the Other Deferral code OD should not be used, instead use the Awaiting Sentence code AS.

Vacated

The court orders the record of conviction of a misdemeanor or gross misdemeanor charge to be vacated. (RCW 9.96 Ch 140 L01)

PLS Date Codes

Date fields on the PLS screen (except those used for calendaring) can accept any of the following date codes which translate to a date when the screen is processed.

When a Date Code is used, the screen will echo the date translation. If the echoed date is incorrect, the user may type over the incorrect date with a correct date. Either <ENTER> or a paging key must be pressed to continue.

Credit for Time Served Codes

These codes are used on the PLS screen in the second portion of the Credit field. The code used determines the text of the docket entry that is created. The first portion of the Credit field is used for the number of days for which the DEF is given credit.

Case Conditions Codes

The Case Conditions section on the Plea/Sentencing Update (PLS) screen includes codes for Case Conditions, Time, and Complied status.

Refer to the Case Conditions Codes (Case Review/Tracking) section for these codes.

 

Time

The first portion of the Time field is the numeric length of time a defendant is ordered to serve or perform the condition.

The second portion of the Time field indicates the time unit:

H = Hours
D = Days
M = Months
Y = Years

Example
Twenty hours of community service would be recorded as “ 20 H”

 

Complied Codes

These codes are used in the C (Complied) field to indicate the defendant’s compliance with the condition of sentence:

E = Excused/Waived
N = No (not complied)
T = Terminated
V = Violated
Y = Yes (complied)

Court Rule CrRLJ 3.2 was amended to remove the language that allowed Bail Forfeitures to be entered as a “final disposition” on criminal cases beginning July 1, 2012. The code remained available through July 16, 2012 on Bail Forfeitable charges issued through June 30, 2012 in order to allow the defendants the full 15 days to pay or appear. The code should not be used for any citation with a violation date July 1, 2012 or later.
