State Supreme Court to Hear Oral Argument at UW Law School this Thursday

January 23, 2006

The Washington Supreme Court will hear oral arguments outside of the Temple of Justice in a community visit to the University of Washington School of Law this Thursday, January 26, 2006.

Beginning at 9 a.m. in Room 133 (also know as the Toni Rembe Appellate Courtroom) Chief Justice Gerry Alexander and Justices Charles W. Johnson, Barbara A. Madsen, Richard B. Sanders, Bobbe J. Bridge, Tom Chambers, Susan Owens, Mary Fairhurst and James M. Johnson will hear the following oral arguments:

·         No. 75312-1, State (respondent) v. Athan (petitioner):  Whether police illegally obtained DNA evidence from the flap of an envelope which was mailed by the defendant in reply to a letter purporting to be from a lawyer but actually sent by police.

·         No. 76581-2, Friends of Washington (respondent) v. McFarland (petitioner):    Whether county ordinances which were enacted pursuant to the Growth Management Act, and which amended county code provisions related to surface water management, clearing and grading, and zoning, are subject to referendum.

·         No. 76800-5 State (respondent) v. Jorden (petitioner):  Whether police violated article I, section 7 of the Washington Constitution by randomly taking names from the guest registry of a motel and running warrant checks on those names.

Immediately following arguments in the two cases, the justices will answer questions from the audience, then recess to conference on the cases until 12:30 p.m.  Justices will then have lunch with faculty and members of the student body, and reconvene at 1:30 p.m. to hear the last case of the day, State v. Jorden.

A day prior to the oral arguments, justices will visit University of Washington Law School classrooms in the afternoon, and meet with law school administrators and members of the faculty at an evening reception.

The Washington Supreme Court has made frequent community visits throughout the state since 1995, and welcomes the public to the oral arguments. Though cameras and video recorders are generally allowed, the Court asks that no flash, other lights or noisy film advance mechanisms be used during the hearings. Only one television camera will be allowed to film the oral arguments; other TV stations are asked to pool coverage.

TVW, Washington’s Public Affairs network will tape the arguments for broadcast at a later time.  Schedule information can be obtained by visiting TVW online at www.tvw.org
