We generally set Jury trials at pre-trial rather than at arraignments. The defense asked for a motion hearing at pretrial so the case was set for motion hearing not a trial. The prosecutor did not request a waiver of time for trial at that time. The defense then asked the prosecutor on 3 separate occasions to sign an agreed continuances which the Prosecutor signed again without requesting a waiver from the defense. At the motion hearing, the trial date was set, and the defense agreed to the trial date. Then 1 week later the defense filed motion to dismiss on violation of speedy trial.
