Summary of Reinstatement of Parental Rights
Law:
REUNIFICATION AFTER TPR AND REORGANIZATION OF
RCW 13.34 ESHB 1624 Chapter 413, Laws 2007
(J,AOC) Establishes a procedure under RCW 13.34
for reinstatement of parental rights in
limited circumstances via petition filed by a child 12
years old or older who has been legally free for at
least three years and whose permanency plan has not been
achieved. Requires a threshold hearing to determine the
parent’s apparent fitness and interest before a hearing on
the merits. If the court then finds by clear and convincing
evidence that reinstatement of parental rights is in
the child’s best interest, the court shall
conditionally grant the petition for six months during
which time the department shall provide transition services
as appropriate. Reinstatement of parental rights is
a separate action from the original termination and does
not vacate the termination. This applies retroactively to
any child under the jurisdiction of juvenile court at the
time of the reinstatement hearing, regardless of the date
parental rights were terminated. |

Reviewed the JCS codes workbook and talked to
Terri:
The JCS codes workbook current has the following
codes related to reinstatement of parents
rights:
DISPOSITION CODES RPA = Reinstatement of
Parents Rights RMO = Reinstatement of Mother's
Rights RFA = Reinstatement of Father's Rights
CASE
RESOLVED REFERRAL/REASON STATUS CSR ET = Parental Rights
Terminated
There is not case resolved status for
parental rights reinstated. Does the JCS members on the codes
committee feel there is a need for case resolved status of
parental rights reinstated and should the codes review be
continued until the JCS workgroup reviews adding a new case
resolved code? |

The only question remaining, is whether this docket
code might need to drive something, or ripple into, JCS. If
not, then I agree completely, this would be simple and
therefore be low-cost. If it needs to impact JCS, they should
analyze that part. |

In researching this matter for you,
I discovered that, when this form was created, the ORCG code
was not proposed to the JIS Codes Committee--apparently the
new code was overlooked. I will add this proposed code to the
committee's April agenda. In the meantime, I'd suggest using
the ORGMT code (adding - conditionally) I'll keep you informed
as to the status of the ORCG code.

I
just checked form WPF JU 04.0800, Order on Hearing Re Petition
for Reinstatement of Terminated Parental Rights. It looks like
the docket code that does not work is “ORCG - Order
Conditionally Granting.”
I checked my email records and
it looks like Kim Eaton provided a docket code for “Order
Conditionally Granting.” Unfortunately, it appears that I
thought she was giving me an existing code. Instead, it was a
recommended code. Since I mistakenly thought it was already a
docket code, I did not forward it to you as a recommendation
for a new docket code for the Codes Committee’s consideration.
My error.
Please forward this request to the Codes
Committee to adopt a code for “Order Conditionally Granting.”
The form containing the language is attached.
Kim, do
you want to recommend ORCG = Order Conditionally Granting? I
noticed that in the interim, the Codes Committee approved
PTORCG = Petition for Order Closing Guardianship. Would the
codes be confusing?
