CAUSE-OF-ACTION REPORTING CATEGORIES

TORT

Injury to another person or damage to another's property that does not involve a contract.

Medical Malpractice (MED) - Suit involving injury resulting from professional medical treatment.

Personal Injury (PIN) - Suit involving physical injury not resulting from professional medical treatment and where a motor vehicle is not involved.

Property Damage (PRP) - Suit involving damage to real or personal property excluding motor vehicles.

Other Malpractice (MAL) - Suit involving injury resulting from other than professional medical treatment.

Tort Motor Vehicle (TMV) - Suit involving damages, injury, or death resulting from an incident involving a motor vehicle. (This usually requires sending a driver's abstract to the DOL if damages are awarded.)

Wrongful Death (WDE) - Suit involving death resulting from other than professional medical treatment.

Tort-OtherOther (TTO) - Any other petition not specified by other codes.

Victims of Motor Vehicle Theft (VVT) – Suit filed by a victim of car theft to recover damages. (RCW 9A.56.078)

COMMERCIAL/COLLECTION

Monetary disputes where damages are not the issue.

Collection (COL) - Dispute where no contract is involved.

Commercial (COM) - Dispute where a contract is involved

PROPERTY RIGHTS

Involves land and items attached to land.

Condemnation (CON) - (Eminent Domain) Governmental taking of private property with payment, but not necessarily with consent. Only one filing and resolution is reported for each condemnation action, no matter how many land parcels are involved.

Foreclosure (FOR) - Termination of ownership rights when a mortgage or tax foreclosure is involved where the ownership is not in question.

Land Use Petition (LUP) – Petition for an expedited judicial review of a land use decision made by a local jurisdiction (RCW 36.70C.040).

Property Fairness (PFA) - Complaint involving the regulation of private property or restraint of land use by a government entity brought forth by Title 64 RCW.

Property Damage-Gangs (PRG) – Complaint to recover damages to property related to gang activity.

Quiet Title (QTI) - Case arising out of the ownership, use, or disposition of land or real estate other than foreclosure.

Unlawful Detainer (UND) - The unjustifiable retention of land, usually by a tenant.

CIVIL HARASSMENT/STALKING PROTECTION

Civil Harassment (HAR) - Petition for protection from civil harassment (RCW 10.14.020).

Sexual Assault Protection Order (SXP) – Petition for protection under RCW 7.90.020.

Stalking (STK) - Petition for protection from stalking for victims who do not qualify for a domestic violence protection order. (RCW 7.92.030) [Effective 7/28/2013]

DOMESTIC VIOLENCE

Domestic Violence Protection (DVP) - Petition for protection order against domestic violence (RCW 26.50.010).

Foreign Protection Order (FPO) – A protection order of a court of the US, or of any other state, territory, or tribal land, which is entitled to full faith and credit in this state.

Vulnerable Adult Protection Order (VAP) – Petition for protection for vulnerable adults as defined in RCW 74.34.020.

ADMINISTRATIVE LAW REVIEW

Administrative Law Review (ALR) - Petition to superior court to review rulings made by state administrative agencies, under RCWs 34.04.080 and 34.04.130.

Appeal of a Department of Licensing Revocation (DOL) - Appeal of a DOL revocation (RCW 46.20.308(9)).

OTHER PETITIONS AND COMPLAINTS

This is a category for civil matters not included in the above categories. This miscellaneous category includes the following petitions for writs and injunctions.

Change of Name (CHN) - Petition for a non-confidential change of name.

Note: For a confidential change of name for a domestic violence victim, see the CHN cause of action under the Adoption/Parentage protected case type .

Emancipation of Minor (EOM) - Petition by a minor for a declaration of emancipation.

Injunction (INJ) - Petition requiring a person to do or refrain from doing a particular thing. Record a petition for injunction as a cause code only if no other claim is made. (Example: If the petition for an injunction is filed with a tort, the filing should be recorded under the tort category.) Only the first injunction is counted as a filing, even if it is a temporary injunction. A later petition for a permanent injunction should not be counted as a separate filing.

Minor Settlement (MST) - Petition for a court decision that an award to a minor is appropriate when no letters of guardianship are required (e.g., net settlement value $25,000 or less; see SPR 98.16W). If letters are necessary, file the petition as a guardianship case.

Malicious Harassment (MHA) - Suit involving damages resulting from malicious harassment.

Petition for Civil Commitment (Sexual Predator) (PCC) - Petition for the involuntary civil commitment of a person who (1) has been convicted of a sexually violent offense whose term of confinement is about to expire or has expired, (2) has been charged with a sexually violent offense and who has been determined to be incompetent to stand trial who is about to be released or has been released, or (3) has been found not guilty by reason of insanity of a sexually violent offense and who is about to be released or has been released, and it appears that the person may be a sexually violent predator.

Public Records Act (PRA) – Actions filed under RCW 42.56.

Restoration of Firearms Rights (RFR) - Petition seeking restoration of firearms rights under RCW 9.41.040 and 9.41.047. Petitioning for restoration of the right to possess a firearm is a separate civil action, outside of any underlying criminal or commitment proceeding, and subject to payment of a filing fee. [Effective 9-2-2014]

School District-Required Action Plan (SDR) – Petition requesting court selection of a required action plan proposal relating to school academic performance.

Seizure of Property from the Commission of a Crime (SPC) - Seizure of personal property which was employed in aiding, abetting, or in the commission of a crime, from a defendant following criminal conviction.

Seizure of Property Resulting from a Crime (SPR) - Seizure of tangible or intangible property which is the direct or indirect result of a crime, from a defendant following criminal conviction (e.g., remuneration for, or contract interest in, a depiction or account of a crime).

Writ of Habeas Corpus (WHC) - Petition for a writ to bring a party before the court.

Miscellaneous Writ (WMW) - Any writ not specified (e.g., writ of replevin, writ of possession, writ of inquiry) not specified by other codes.

Writ of Mandamus (WRM) - Petition for a writ commanding the performance of a particular act or duty.

Writ of Restitution (WRR) - A writ restoring property or proceeds, and by statute this writ is a remedy available to property owners in unlawful detainer actions.

Writ of Review (WRV) - Petition for review of the record or decision of a case pending in the lower court. Does not include lower court appeals or administrative law reviews.

Miscellaneous (MSC) - Any other petition not specified by other codes.

APPEALS FROM LOWER COURTS

Appeals from courts of limited jurisdiction to the superior court, including both RALJ and de novo appeals.

Lower Court Appeal - Civil (LCA) - An appeal from a court of limited jurisdiction to superior court except for traffic infraction or criminal matters.

Lower Court Appeal - Infraction Infraction (LCI) - An appeal from a court of limited jurisdiction to superior court for a traffic infraction matter.

MATTERS FILED WITH CLERK

Includes matters that are handled primarily by the clerk, such as tax warrants or abstracts of judgment from another court. Each matter should first be filed as a civil case to establish jurisdiction, before filing the judgment on SCOMIS. A separate filing is reported for each matter filed. This type of matter is normally resolved and completed at the same time it is filed.

Tax Warrant (TAX) - A notice of assessment by a state agency creating a judgment/lien in the county in which it is filed.

Abstract of Judgment (ABJ) - An abstract is a certified copy of entries in the judgment docket. The superior court files abstracts of judgment from other superior courts, the appellate courts, and the federal district courts.

Transcript of Judgment (TRJ) - A transcript is a certified copy of a judgment from a court of limited jurisdiction to a superior court in the same county.

Foreign Judgment (FJU) - Any judgment, decree, or order of a court of the United States, or of any state or territory which is entitled to full faith and credit in this state.
