6. PROCEEDINGS STRICKEN/CANCELED

A stricken proceeding is one removed from the court calendar by a judicial officer and is not recorded on a calendar to take place at another date. A canceled proceeding is one removed from the court calendar by a non-judicial officer and is not recorded on a calendar to take place at another date.

A stricken or canceled proceeding is only an instance where a proceeding has been set for a specific date and is stricken or canceled before that hearing commences. If a proceeding has been initiated, do not docket that it has been stricken or canceled.

If the proceeding is stricken in court before the scheduled proceeding commences, and if the motion to strike was argued in court or an order to strike the proceeding was filed, docket a "MTHRG" (motion hearing) in addition to the stricken proceeding. Unless the above criteria are met, do not docket a motion hearing if a status conference is stricken.

A stricken or canceled proceeding code should be used when a different type of proceeding will be scheduled in lieu of the stricken or canceled proceeding.

All proceeding stricken/canceled docket codes are reported under the single category "stricken/canceled."

PROCEEDING STRICKEN/CANCELED CATEGORIES - The following categories are in descending order by their resource impact on the court. Therefore, use the first code in the list that applies.

Stricken At Scheduled Time For Non-Appearance

(HSTKNA) - A hearing stricken in court at the time the hearing was set to occur caused by a party failing to appear.

(TSTKNA) - A fact finding hearing stricken in court at the time the fact finding hearing was set to occur caused by a party failing to appear.

Stricken At Scheduled Time for Other Than Non-Appearance

(HSTKIC) - A hearing stricken in court at the time the hearing was set to occur for reasons other than a party failing to appear.

(TSTKIC) - A fact finding hearing stricken in court at the time the fact finding hearing was set to occur for reasons other than a party failing to appear.

Canceled Prior-To At Court's Request

(HSTKCC) - A hearing canceled at the court's request because of a court calendar conflict, but not stricken in court.

(TSTKCC) - A fact finding hearing canceled at the court's request because of a court calendar conflict, but not stricken in court.

Canceled Prior-To At Defense Request

(HSTKDA) - A hearing canceled at the request of the defense, not due to a court calendar conflict and prior to the date it was set to occur.

(TSTKDA) - A fact finding hearing canceled at the request of the defense, not due to a court calendar conflict and prior to the date it was set to occur.

Canceled Prior-To At Prosecutor's Request

(HSTKPA) - A hearing canceled at the request of the prosecuting attorney, not due to a court calendar conflict and prior to the date it was set to occur.

(TSTKPA) - A fact finding hearing canceled at the request of the prosecuting attorney, not due to a court calendar conflict and prior to the date it was set to occur.

Canceled Prior-To By Stipulation

(HSTKSTP) - A hearing stricken at the request of all concerned parties, not due to a court calendar conflict and prior to the date it was set to occur.

(TSTKSTP) - A fact finding hearing stricken at the request of all concerned parties, not due to a court calendar conflict and prior to the date it was set to occur.

Canceled Prior-To By Unknown Party

(HSTKU) - A hearing canceled at the request of unknown concerned parties for reasons other than a court calendar conflict and prior to the date it was set to occur.

(TSTKU) - A fact finding hearing canceled at the request of unknown concerned parties for reasons other than a court calendar conflict and prior to the date it was set to occur.
