General Orders of Division II2017-2 Rescinding and Replacing General Order 2003-4 Regarding Dispositions of Motions to File an Amicus Curiae Brief2017-2 Order Rescinding And Replacing General Order 2003-4 Regarding Dispositions Of Motions To File An Amicus Curiae Brief Rule of Appellate Procedure 10.6(e) provides that each division of the Court of Appeals shall establish by general order the manner of disposition of a motion to file an amicus curiae brief. The Court, by this order, is rescinding General Order 2003-04 and replacing it with this new General Order 2017-2. IT IS SO ORDERED: (1) If the court has not set a date for oral argument before a panel of judges, the motion to file an amicus curiae brief shall be decided by a commissioner of this court in a written ruling. The commissioner’s ruling is subject to a motion to modify in accordance with Rule of Appellate Procedure 17.7. (2) If the court has set a date for oral argument before a panel of judges, the motion to file an amicus curiae brief shall be decided by that panel of judges. The panel shall issue a written order. The panel’s order is not subject to a motion for reconsideration. Dated this 22nd day of August 2017
