(1) Days to reach the 75th percentile for the full period (filing to opinion) do not necessarily equal the sum of the days for the event categories within that period. (2) Time-in-process figures for 2002 have been updated to reflect a full twelve months' data for all divisions with the completion of statewide conversion to the new Appellate Court Records and Data System (ACORDS-II). Division II's measurements in the 2002 publication were based on the period 1/01/2002 through 11/17/2002 from the old ACORDS system, prior to their 11/18/2002 implementation of ACORDS-II. This update achieved comparability with the other divisions, which implemented in early 2003.
(3) Among the civil appeals resolved in the second quarter 2023 were over 72 Spokane County guardianship proceedings filed in February 2016, which account for 47% of the cases in this category. The consolidated proceedings were atypically very protracted given the volume. In each appeal, two sets of judgments and orders in these appeals were at issue. See In the Matter of the Guardianship of Donald Raymond Mitchell and Other Similar Cases Consolidated on Appeal, No 34236-1-III, slip. op., 342361_unp.pdf (wa.gov) The process of opening the appeals and obtaining the trial court records was cumbersome and time-consuming at both the superior and appellate court levels. Motions relating to the
record on review and participation of amicus for the county guardianship program were required to be resolved before briefing could be completed. Briefing was completed in August 2022.
