Judge Lawler called the meeting to order at 8:05. Board Business 1. Approval of Minutes A motion was made and seconded to approve the minutes as presented for the Board meeting held on October 11, 2010. The motion passed.[1] 2. Chair Report Judge Lawler reported on the following topics:
a) Judge Wickham sent a letter to the WSBA Elder Law Section regarding the Board’s responses to the proposed legislative changes.
b) Judge Wickham sent a letter to the BJA Public Records Work Group regarding the proposed changes to GR 31.
3. Committee Reports
a. Nominating Committee: Judge Prochnau reported that there was a good group of applicants for Dr. Ruth Craven’s position. The Committee recommended two candidates to Judge Wickham and he selected one and has forwarded Dr. Barbara Cochrane’s name to the Supreme Court for appointment.
Carol Sloan’s name was also forwarded to the Supreme Court to replace Ree Ah Bloedow. Ms. Sloan is an Adult Protective Services Program Manager.
b. Standards of Practice Committee:
CPGB No. 2009-006: Jennifer Elias reported that the guardian came to the Board’s attention through both a grievance and the DR 520 Audit. The guardian failed to file timely reports in 4 separate Snohomish County cases. The guardian agreed to settle the matter and to pay the Board’s costs.
c. Applications Committee
Judge Prochnau reported that the Applications Committee was recommending a change to the regulation regarding when a person must pay his/her dues following notice of approval by the Board. The change was recommended because the Board does not pro-rate fees and a guardian applicant may not wish to pay annual dues in May when he/she will have to pay them again by August 1. A motion was made and seconded to approve changes to the Application Regulations as follows:
111.3 Initial Certification Fee
111.3.1 The initial certification fee for both individuals and agencies is due sixty (60)
111.3.2 The initial certification fee is not prorated.
111.3.3 Upon receipt of the initial certification fee, the application will be forwarded to the Supreme Court with the Board’s recommendation for certification.
111.4 Failure to Pay Initial Certification Fee
In the event an applicant does not timely pay the initial certification fee, the Board will not forward the application to the Supreme Court for certification, and the Board will deny certification.
This proposed change will be posted on the CPG Web site for comment.
4. Executive Session
The Board adjourned to executive session to consider the disciplinary matter, applications, a request for inactive status, and decertifications for failure to pay dues.
5. Open Session The Board reconvened in open session and took the following actions: a. CPGB No. 2009-006: A motion was made and seconded to adopt the proposed Agreement Regarding Discipline. The motion passed. Members of the SOPC abstained. b. Motion and second for conditional approval[3] of each of the following applications for certification. Motion passed:

c. Motion and second to approve the request for inactive status of Jeffrey Buchan, CPG #19431. Motion passed.
d. Motion and second for decertification for failure to pay annual dues/file annual disclosure of each of the following guardians. Motion passed:
Stephanie Galbraith CPG # 10578
Bonnie Edwards Schultz CPG #10310
e. Motion and second to accept the petition filed by Stephanie McGruder, CPG #10875 regarding her filing of the annual disclosure and payment of fees. Motion passed.
f. Motion made and seconded to deny Delina Perdue’s request for the CPG Board to waive the educational requirement and to send her a letter stating that the Board cannot waive a court rule. Motion passed.
Adjourn Judge Lawler noted that the December teleconference has been cancelled and the next meeting will be on January 10, 2011 and that the meeting is planned to last until 3:00 pm. Judge Lawler adjourned the meeting at approximately 8:40 am.
