                                                 LCR 56.
                                             SUMMARY JUDGMENT

     (a) Motion and Proceedings. Motions for summary judgment, partial summary judgment or dismissal under
CR 12 must be served and filed at least twenty-eight (28) days prior to the hearing and heard at least
fourteen (14) calendar days prior to the date the case is set for trial. Any responding documents must be
served and filed at least eleven (11) calendar days before the hearing. Any reply documents must be served
and filed at least five (5) days before the hearing. If the date for filing either the response or rebuttal
falls on a Saturday, Sunday or legal holiday, then it shall be filed and served not later than the next day
nearer the hearing, which is neither a Saturday, Sunday or legal holiday. In the event a motion for summary
judgment, partial summary judgment or dismissal is to be argued, counsel for the moving party shall comply
with the requirements of LCR 40.

     (b) Page Limits. The moving and response memoranda or briefs shall not exceed twenty (20) pages, not
including exhibits. The reply memorandum shall not exceed seven (7) pages, not including exhibits. No
response or reply may include any document attached to or a part of the initial motion, memorandum or brief,
the response, or document already filed as part of the subject motion, but instead shall cite to the relevant
portion of the previously filed document. All documents shall be double-spaced and typed in Times New Roman
font no smaller than 12 point, including footnotes, if any. The writing or printing shall appear on only side
of the page. These page limits shall not be exceeded without a motion and prior authorization of the court.
A Motion to exceed the page limits must demonstrate good cause and explain the steps taken to reduce the
number of pages.

     (c) Failure to comply with LCR 40 or LCR 56. In the event a party fails to comply with LCR 40 or LCR 56
the court shall have discretion to impose the remedies and sanctions set forth in LCR 40(b)(6).
