3.       Purpose of Suggested Rule Amendment

 

This proposed amendment is to give notice to a potential witness that the deposition may be held by remote means and so changes the notice that witness must be given. The Civil Group unanimously supports this change.

 

This amendment is not intended to change Washington law or the law of any other state regarding a witness’ rights or the legal requirements to subpoena in another state.

 

 

4.       Is Expedited Consideration Requested?

 

Expedited consideration is essential. The Court should seriously consider passing amended rules permitting remote proceedings before the Supreme Court’s Emergency Order is lifted. Use of remote technology in superior courts is now widespread. For some jurisdictions, it has become essential to maintain access to justice.
