C. Purpose: These suggested amendments to the Limited License Legal Technician (LLLT) Rules of Professional Conduct (LLLT RPC) are presented in conjunction with suggested amendments to the Rules of Professional Conduct for lawyers (Lawyer RPC). These suggested amendments, like the suggested amendments to the Lawyer RPC, are designed to simplify the regulation of LLLT advertising, promote innovation in marketing, and improve access to legal services. A detailed analysis of the purpose including the procedural background for the development for these suggested amendments is set forth in the GR 9 Cover Sheet for the suggested amendments to the Lawyer RPC 7.1, 7.2, 7.3, 7.4, 7.5, and 5.5, which is being submitted contemporaneously.

    The primary suggested amendments are to Title 7 of the LLLT RPC and generally mirror the suggested amendments to the Lawyer RPC. The following suggested amendments relate to LLLTs only and are not included in the suggested amendments to the Lawyer RPC:

      ● Suggested amendments to LLLT RPC 7.1 include a subsection (b) to require LLLTs to state in all communications about themselves or their services that they have limited licenses to practice in a particular field of law and to prohibit stating or implying otherwise. This provision would move from its current location in LLLT RPC 7.4, which is to be reserved.

      ● Comment 2 would be added to LLLT RPC 7.1 to clarify that the words “Legal Technician” must be included in the firm name when there are no lawyers in the firm. This provision would move from its current location in LLLT RPC 7.5(a), which also is to be reserved.

      ● There are two suggested amendments that are necessary merely to correct references to provisions that would move to different rules; those are LLLT RPC 1.0B cmt. 3 and LLLT RPC 1.5 cmt. 3.
