What is the Business Problem or Opportunity

Current practices for offender processing in Washington Trial Courts (first appearance/arraignment) do not include any form of risk assessment that provides objective information to inform pre-trial decisions on bail and/or custody. Judicial officers (SCJA/DMCJA) are formally requesting support for enabling a tool based risk assessment that allows for optimizing standard practices across all trial courts and improving overall decisions made at the onset of the pre-trial process.

Expected Benefit:

Courts and Department of Corrections (DOC) can use the same risks assessment tool and supporting database to conduct research and analysis of felony level offenders, risk score calculation, and measure effectiveness of interventions.

Request Summary:

Both the Superior Court Judges Association (SCJA) and the District and Municipal Court Judges Association (DMCJA) are highly interested in implementing a validated, actuarially based risk assessment tool to provide trial courts standardized calculations of adult defendants' risk to commit future violations.

Business Impacts:

The Adult Risk Assessment toll will be used to support pre-trial release decisions; however the Courts envision eventually using the assessment system to provide input into evidence based alternative sentencing decisions as well.

Summary of Proposed Solution

The Administrative Office of the Courts (AOC) proposes to conduct a feasibility study to determine the ability of the Courts and AOC to implement and utilize the Static Risk and Offender Need Guide (STRONG) risk assessment tool. The study is required for AOC to be able to produce actionable estimates of the resources and timeframe needed to successfully implement this tool into the Courts. The draft charter that is also attached to this request details the scope and goals of the feasibility study.

Proposed Solution

AOC will charter an Adult Risk Assessment Workgroup. Initially the Workgroup will devise a work plan. The Workgroup will also identify the group of stakeholders through which the feasibility study will be vetted.

Next, the Workgroup will perform the feasibility analysis. The analysis will likely take two paths, one to examine issues related to automating the collection and transformation of data that feeds the assessment tool and the other to develop a high level business process workflow.

While DOC is open to discussing a partnership, they are not currently committed to engaging in one. They have also said they have no resources to help with the effort. To mitigate this risk, the Workgroup will likely address two scenarios; one based on a full partnership with DOC and one in which DOC's role is to provide an automated feed of supervision violation data. The Workgroup will meet with DOC to share its findings and explore the viability of a data-sharing partnership.
