What is the Business Problem or Opportunity

This request is a resubmission of an old request (ITG 217) that was never completed. The problems identified below still remain prevalent in the courts.

Courts are required to provide interpreters for people who need them in order to be able to access the court. The scheduling of court interpreters is for most courts, a manual, labor-intensive process. Considerations include the availability of interpreters in a given language, the location and length of the encounter, the qualifications of the interpreter, the proximity of the interpreter to the court, the amount of notice the court has regarding the need for the interpreter service, and so on.

Some courts are now using interpreter scheduling services to assist with this process. The courts that are using a scheduling service are able to save money by utlizing their court staff more effectively, provide access to justice by ensuring that people who need interpreters are provided one without delay, and communicate more efficiently with interpreters to notify them of updates and cancellations - thereby saving everone money and time.

Having a centralized interpreter scheduling system that could be utilized by all courts would help save courts time, money, and would increase access to justice throughout the state.

Starting fiscal year 2021-22, all courts across the state will be invited to be a part of the Interperter Reimbursement Program. One of the major requirements of courts in the program is reporting interpreter usage data. Courts currently in the program feel that the data reporting requirement is too cumbersome and takes too much of their staff time. Having a centralized interpreter scheduling system could solve that issue because the data would already be reported through the scheduling function and there would no longer be the need for courts to input interpreter data into a different system.

Lastly, COVID-19 forced the courts and interpreters to shift their work online. Several courts and interpreters were making access to the courts happen through video remote interpreting and telephonic interpreting, moreso than ever before. ISome of the current interpreter scheduling systems include features that allow courts to request interpreters in-person, video remote, or telephonic, whichever is most appropriate for the given circumstance.

Expected Benefit:
  • Greater accessibility to the courts for people who speak languages other than English or are deaf or hard of hearing. Courts will be quicker and more responsive to requests for interpreters.
  • An easier, more efficient, and more effective way for courts to request court credentialed interpreters, and for interpreters to accept and calendar multiple court assignments.
  • Less court staff time needed to schedule interpreters, more court staff time spent on other court matters.
  • Less money wasted on interpreter cancellations because it will be easier and quicker for courts to schedule and cancel interpreters without incurring cancellation costs.
  • Less court staff time needed to input court interpreting data needed for the Court Interpreter Reimbursement program.
  • The limited English proficient (LEF) or deaf person has the potential to have consistent language services throughout a case. Currently, most courts do not have an interpreter assignment tracking system to ensure that the same interpreter is assigned to the same case going forward without having to open other applications to do so.
Any Additional Information:

An optimal solution would provide a statewide, online scheduling application that could be viewed by all court staff that are assigned to deal with interpreter scheduling. At a minimum the system would capture and allow searches based on court proceeding information, language requirement, payment terms, expected job duration, interpreter travel distance, etc. It would also provide a list of court credentialed or otherwise qualified interpreters for any given set of circumstances and provide notification, confirmation, and reminder services via email and text. The system would track usage and be able to generate data reports that would ideally connect to the court interpreter reimbursement program and the court management systems.

The system would also have the ability to directly connect to or at the very least, provide information for remote participation by the interpreter either by telephone or video.

There is currently at least one online interpreter scheduling system in Washington State that courts are using, 1Lingua. A business analysis was conducted on 1Lingua back in 2017 by Stephanie Ford. It would be good to look at this analysis in light of this request.

Request Summary:

In order to ensure equitable access to the courts, courts must provide interpreters for court customers who have limited English proficiency or are deaf or hard of hearing. Scheduling court interpreters can be a complex process for the courts as interpreter scheduling is often times a manual, labor-intensive process for court staff, and the ramifications and stakes of not being able to get a court credentialed interpreter in a timely manner is an access to justice issue. Considerations for scheduling include the availability of interpreters in a given language, the location and length of the encounter, the qualifications of the interpreter, the proximity of the interpreter to the court, the amount of notice the court needs to provide for the interpreter service, and so on.
A number of courts have found solutions to the otherwise manual process of scheduling interpreters. One solution is to pay a commercial vendor who helps the court schedule interpreters. That solution adds additional costs to the court and to the interpreter to pay the vendor for the service. Another solution that courts have found is using an online interpreter scheduling service, operating as a software as service platform. This solution has proven to be a cost-effective and efficient way for courts to schedule court credentialed interpreters in a timely manner. Unfortunately, one of the most popular online interpreter scheduling services plans to discontinue this service.

Business Impacts:

This package supports the objective of Accessibility by promoting equal access to justice for all individuals regardless of their ability to communicate in the spoken English language. Language interpreters play an essential role in ensuring due process and helping court proceedings function efficiently and effectively.
This package supports the objective of Commitment to Effective Court Management by making a state-provided software application available for courts to schedule court interpreters. This application would reduce costs to courts currently using third-party software products and would provide courts using manual process a more efficient process to complete this vital function.
