Criminal cases frequently have the scenario where 2 victims exist, one being a family/household member and the other not. DV is alleged on the charges due to the family member victim. If an HNO is entered protecting the non-family/household member, the clerk is required to enter the order as a NCO to work around the DV flag requirement where HNO is not allowed when the DV flag is present. We're requesting that Harassment No Contact Orders allow DV = Y or N so the clerk can accurately document the order type without a work around.
DVP cases always require DV = Y when an order is entered including when an order has been denied. Clerks have been using a work around to temporarily add the DV flag, add the Denied order and then remove the flag. We're requesting that DVP case types allow DV = Y or N to accommodate this scenario without a work around. Currently, the DV flag is set to trigger to “Y” when the clerk enters the event “temporary order for protection”.
