What is the Business Problem or Opportunity

A judge cannot see that a DUI was dismissed based on completion of a deferred prosecution. A regular dismissal is very different from a dismissal based on a successful completion of a deferred prosecution. A dismissal from a deferred prosecution counts as a prior offense under state law for sentencing purposes on a subsequent DUI conviction. The only way now to know if a dismissal is based on a deferred prosecution is to open the docket from the case or check the abstract of driving record. Up until 2 years ago, a DUI only remained on an ADR for 15 years. Also, the judge at arraignment should not have to check both the DCH and ADR, or possibly other court dockets to get this valuable piece of information.

Expected Benefit:

A judge at arraignment and sentencing will know if a prior dismissed DUI was the result of completion of a deferred prosecution. This will provide information that the person was assessed as alcohol dependent for this deferred prosecution. This information helps a judge determine proper conditions of pretrial release. A DUI dismissed as a deferred prosecution is a prior offense for sentencing purposes.

Request Summary:

This request is for an enhancement to JIS to show the reason for dismissal of a DUI case on the DCH screen.

Business Impacts:

This enhancement would provide judges with more accurate information on previous DUIs by showing if the DUI was dismissed based upon completion of a deferred prosecution. This enhancement would also provide judges with the reason for dismissal on DCH, ICH, and in JABS and will eliminate the need to look at the docket to find the reason for dismissal.

Summary of Proposed Solution

The Administrative Office of the Courts (AOC) would modify two screens in the Judicial Information System (JIS) and also modify the Judicial Access Browser System (JABS) to display the dismissal reason on the same screens as the criminal history.

Proposed Solution

1. Modify two screens in JIS: Defendant Criminal History (DCH) and Individual Criminal History (ICH).

2. Modify JABS to display the dismissal reason code which is entered on the PLS screen in JIS.

3. Because sufficient space for a new column does not exist on DCH, ICH, or in JABS, the Short Title field on DCH, ICH, and JABS would have to be shortened to add a new column.

4. AOC would also modify JABS to complete the existing ClearQuest (CQ) item (#OAC00015536) which is a request to display all PLS information in JABS.

Additional Notes

A recent upgrade was made to JABS, which now shows the DUI dismissal reason in the Summary tab. There is also a pending IT governance request (#96) that would create a Plea and Sentencing tab in JABS with more complete information from both JIS and SCOMIS.

Given these developments, the DMCJA Endorsing group asked the CLUG to decline this request. Therefore, the CLUG is declining this request on the recommendation of the DMCJA Endorsing Group.
