Canon 7(B)(1)(c) provides in part that judicial candidates
should not make pledges or promises of conduct in office
other than the faithful and impartial performance of
the duties of the office or make statements that commit
or appear to commit the candidate with respect to cases,
controversies or issues that are likely to come before
the court.
Because of the nature of many
of the questions on these types of questionnaires, it may
be inappropriate for a candidate to answer them. If they
will cause the candidate to comment on issues that come
before a judge or give the impression that a judge is committed
to acting in a certain way if a particular issue were before
that judge, it would not be appropriate for the candidate
to answer the questions.
It may be a candidate
will be able to answer only some of the questions on
the questionnaire. Where a candidate is prohibited from
answering a question, the candidate may explain the restrictions
set out in the Code of Judicial Conduct, which limit
his or her ability to respond.
