Washington Supreme Court Schedules Oral Argument Regarding Recount in Election for Governor

December 08, 2004

The Washington Supreme Court issued an order this morning scheduling oral argument in McDonald, et al. v. Reed, et al. on Monday, December 13 at 1:30 p.m. at the Temple of Justice in Olympia.  The court also granted the motion of Dino Rossi and the Republican Party to intervene in the action and ordered that the recount may continue under rules and regulations now in place subject to later order of the court.  An electronic copy of the order may be found at the Washington Courts website at www.courts.wa.gov.

The oral argument will focus on a petition for writ of mandamus and other relief that was filed by the Washington State Democratic Party on Friday, December 3, asking the Supreme Court to order the Secretary of State to make certain rules and regulations to guide the recount in the election for Governor.  Briefs from all parties were filed with the Washington Supreme Court on Tuesday, December 7.

The Court will review the case in an expedited manner, and will post its decision via the Washington Courts website at www.courts.wa.gov as soon as it becomes available.

Oral argument in the case is open to the public, with limited seating available on a first-come, first-serve basis.  The entire proceeding will be covered live by Washington’s public affairs station, TVW.
