Eviction Resolution Pilot Program

The Eviction Resolution Pilot Program (ERPP) is sunsetting
on June 30, 2023, per E2SSB 5160.

About the Program

Recognizing the risk of mass evictions flowing from the COVID-19 emergency, federal, state, and local governments enacted moratoria on evictions. When in effect, these moratoria effectively denied landlords access to the only legal means of removing tenants for failure to pay all or part of their rents — the unlawful detainer process.

During the 2021 session, the Washington State Legislature passed E2SSB 5160 authorizing the establishment of an Eviction Resolution Pilot Program (ERPP) in any county in Washington State. Subsequently, many courts across the state have taken steps to establish an Eviction Resolution Pilot Program within their jurisdictions.

In anticipation of the moratoria lifting, and the large number of eviction actions that would likely be initiated in superior courts across the state, the Supreme Court issued an enabling order regarding the establishment of an ERPP. Six counties elected to participate in the initial pilot (King, Pierce, Snohomish, Clark, Spokane and Thurston), and each pilot program operated pursuant to a standing order of the superior court. The program was designed to connect landlords and tenants with a dispute resolution specialist and needed resources, such as rental assistance, before filing a court action and operated pursuant to a standing order of the superior court.

Per E2SSB 5160, ERPP will sunset on June 30th, 2023.
