The Certified Professional Guardianship Board is proposing amendments to Regulation 409 Financial Management, Regulation 410 Guardian Fees and Expenses, Regulation 411 Changes of Circumstances/Modification/Termination, Regulation 412 Sale or Purchase of Guardianship Practice, Regulation 413 Responsibilities of Certified Professional Guardian Agencies, Regulation 414 Delegation, and Regulation 415 Record Keeping. The amendments are proposed in response to the passage of the Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act, that will become effective with respect to adult guardianships and all conservatorships on January 1, 2022. The proposed amendments to Regulation 409 Financial Management, Regulation 410 Guardian Fees and Expenses, Regulation 411 Changes of Circumstances/Modification/Termination, Regulation 412 Sale or Purchase of Guardianship Practice, Regulation 413 Responsibilities of Certified Professional Guardian Agencies, Regulation 414 Delegation, and Regulation 415 Record Keeping were discussed by the Certified Professional Guardianship Board (CPGB) at the October 11, 2021 Board Meeting.

The Certified Professional Guardianship Board is proposing amendments to Regulation 404 Contact with the Incapacitated Person, Regulation Series 000 Administrative Regulations, Regulation Series 200 Continuing Education Regulations, Regulation Series 300 Ethics Advisory Opinion Regulations, Regulation Series 500 Disciplinary Regulations for Certified Professional Guardians, Regulation Series 600 Procedure for Adoption, Amendment, and Repeal of Regulations, and Regulation Series 700 Certification Maintenance Regulations. The amendments are proposed in response to the passage of the Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act, that will become effective with respect to adult guardianships and all conservatorships on January 1, 2022. May 22, 2015, the Certified Professional Guardianship Board posted a Request for Comment on revisions to Administrative Regulation 003, with a comment period expiring on September 14, 2015. All comments should be submitted to the Guardian Program or Shirley Bondon by either U.S. mail or email at Guardian Program, Administrative Office of the Courts, P.O. Box 41170, Olympia, WA 98504-1170, or emailed to guardianshipprogram@courts.wa.gov.

July 23 2014, the Certified Professional Guardianship Board posted a Request for Comment on revisions to Application Regulation 102.4, Certification Maintenance Regulation 702.2 and Proposed Standard of Practice Regulation 413 Responsibilities of Certified Professional Guardian Agencies with a comment period expiring on November 10, 2014. June 2014 - Proposed Rules Published for Comment

The Certified Professional Guardianship Board has posted a Request for Comment with a comment period to expire on November 10, 2014.

In accordance with the Board's Communication Plan and Regulation 600, Procedure for the Adoption, Amendment and Repeal of Regulations, on November 17, 2014, the Certified Professional Guardianship Board will discuss and may act on the Request for Comment.

June 2013 - Proposed Rules Published for Comment
The Guardian Board, at their June 10, 2013 meeting, approved new regulations and proposed amendments to be published for comments, with a comment period to expire on July 26, 2013. The proposed new SOP is 413 Responsibilities of Certified Professional Guardian Agencies. The proposed amendment is for significant revisions and reorganization of Disciplinary Regulation 500.

August 2012 - Proposed Rules Published for Comment
In accordance with Regulation 600, Procedure for the Adoption, Amendment, and Repeal of Regulations, Regulation 602, on October 8, 2012, the Certified Professional Guardian Board will act on Disciplinary Regulation 511. The changes and additions are set out below. The Board will meet at 9 am at the SeaTac Office Facility, 18000 International Blvd., Ste 1106, SeaTac, WA.

Revision to Disciplinary Regulation 511 published for comment August 22, 2012 has a comment period which ends September 24, 2012.
 

May 2012 - Proposed Rules Published for Comment
In accordance with Regulation 600, Procedure for the Adoption, Amendment, and Repeal of Regulations, Regulation 602, on July 9, 2012, the Certified Professional Guardian Board will act on Regulation 100, 700 and the Fees and Filing Requirements Table. The changes and additions are set out below. A teleconference will be held at 8 a.m.

The Regulation Revisions and Fees and Filing Requirements Table have a comment period which expires June 18, 2012.

April 2012 - Proposed Rules Published for Comment
The Proposed Standard of Practice Revision Published for Comment April 10, 2012 has a comment period which expires May 9, 2012.   

On May 14, 2012, the Certified Professional Guardian Board will act on SOP 410.2. The changes are set out below. A teleconference will be held at 8 a.m.

February 2012 - Proposed Rules Published for Comment
On April 9, 2012, the Certified Professional Guardian Board will act on Continuing Education Regulations 200.  The meeting will be held at the SeaTac Airport Center, 18000 International Blvd., Suite 1106, SeaTac, Washington. The meeting starts at 9 a.m.

Proposed Regulation Revision Published for Comment February 13, 2012 has a comment period which expires April 9, 2012.

October 2011 - Proposed Rules Published for Comment
Changes have been proposed to the following:  Regulation 102 and 119,  Regulations 103.2.7-103.2.8, Regulation 003.5, Regulations SOP 406, Regulation 515, Regulations 503.14-.16, and Disciplinary Regulation 511. 

Changes were approved for Comment October 10, 2011 and have a comment period which expires November 14, 2011.

September 2011 - Proposed Rules Published for Comment
The Certified Professional Guardian Board will consider amendments to 511 Hearings at its meeting on November 14, 2011. The comment period expires October 13, 2011.

August 2011 - Proposed Rules Published for Comment
The Certified Professional Guardian Board will consider proposed amendments to Continuing Education Regulation 201, 202, 213  at its meeting on October 10, 2011. The comment period expires September 12, 2011.

June 2011 - Proposed Rules Published for Comment
The Certified Professional Guardian Board will consider proposed amendments to Continuing Education Regulation 205.1 at its meeting on August 8, 2011. The comment period expires July 28, 2011.

January 2009 - Proposed Rules Published for Comment

The Certified Professional Guardianship and Conservatorship Board is proposing amendments to Regulation 204 Standards for Approval, Regulation 205 Procedure for Approval of Continuing Education Activities and Regulation 213 Exemptions.

The amendments are proposed to: (i) establish a continuing review procedure for prerecorded CEUs, (ii) provide presumptive approval for education courses approved by the WSBA, and (iii) clarify the types of credits required for newly certified CPGCs and correct a cross-reference in the regulations. The proposed amendments to Regulation 204 Standards for Approval, Regulation 205 Procedure for Approval of Continuing Education Activities and Regulation 213 Exemptions were discussed by the Certified Professional Guardianship and Conservatorship Board (CPGCB) at the July 10, 2023 Board Meeting.

August 2020 - Proposed Rules Published for Comment
The Certified Professional Guardianship Board is proposing a revision to Continuing Education Regulation 202. The revision is proposed in response to the global COVID 19 pandemic and the reduced availability of CEU courses as a result of the pandemic.

The proposed revision to Continuing Education Regulation 202 was discussed by the Certified Professional Guardianship Board (CPGB) at the August 10, 2020 Board Meeting.

The proposed revision is as follows (added language is underlined and bolded):

202 Continuing Education Requirements

Each Guardian shall complete a minimum of 24 credit hours of approved education during each reporting period, except as exempted by Regulation 213.Credit hours accrue for classes approved by the Education Committee and shall biennially total no fewer than 24 credit hours that must include four Ethics credits, and four Emerging Issues credits. All other credits are categorized as General Credits.

If an active Guardian completes more than 24 credit hours in a given reporting period, the excess credit, up to 12 credits will be carried forward and applied to such Guardian's education requirement for the next reporting period. Ten (10) General and two (2) Ethics credits, will be carried forward to the next reporting period in their original categories. Excess Emerging Issues credits will be carried forward as General Credits.

Failure to comply with the provisions of this regulation within each reporting period shall subject the Guardian to disciplinary action, including decertification for failure to comply. (Revised 4-9-12)

Emergency Regulation Change for 2019-2020 Reporting Period

Due to impacts of COVID-19 on the availability of approved continuing education credit hours for the 2019-2020 reporting period, each Guardian shall complete a minimum of 12 credit hours of approved education. These 12 credit hours must include two Ethics credits and two Emerging Issues credits. At the end of the 2019- 2020 reporting period a Guardian who completes more than 12 credit hours may carry forward 24 credits. These credits carried forward may include four (4) Ethics credit and two (2) Emerging Issues credit.

These changes will be effective retroactively to January 1, 2019 as of the date these regulations are adopted until the end of the 2019-2020 reporting period on December 31, 2020.

Board Consideration of Adoption

The Board will review comments, discuss and consider adopting the proposed revision during its October 12, 2020 Board meeting.

The Certified Professional Guardianship Board is proposing a revision to Continuing Education Regulation 201.12. The revision is proposed in order to allow more flexibility in what CEU courses can receive Emerging Issues credit. The proposed revision would allow a CEU Sponsor to request the Board, through the Education Committee, approve CEU courses for Emerging Issues credit, even if the course does not fit into one of the Board's preapproved Emerging Issues categories, so long as the CEU course covers a topic of important significance to the guardianship profession and the topic or issue has arisen during the current CEU reporting period.

The proposed revision to Continuing Education Regulation 201.12 was discussed by the Certified Professional Guardianship Board (CPGB) at the August 12, 2019 Board Meeting.

The proposed revision is as follows (added language is underlined and bolded):

201.12 To qualify for 'emerging issues credit' a course of subject must encompass training and information pertaining to a topic specifically identified by the Board. The Board will determine for each reporting period which emerging issue(s) should be addressed in guardianship education. Emerging Issues shall be identified by the Board at least five months prior to the topic's corresponding reporting period. A CEU Sponsor may choose to include with their CEU application a written request that the Board approve a topic outside of the preapproved Emerging Issues categories as Emerging Issues credit. The request must provide explanation as to how the topic is of important significance to the guardianship profession and that the topic or issue has arisen during the current reporting period. AOC Staff have discretion to approve or deny a request for a topic to be approved as an Emerging Issues credit. Any approval or denial of a topic as Emerging Issues must be ratified by the Education Committee. A credit that is denied as an Emerging Issue may be approved as a General credit."

The Certified Professional Guardianship Board is proposing a revision to Continuing Education Regulation by adding a new section, Section 205.6, to the Continuing Education Regulations. The revision is proposed in order to allow the Board to promote more CEU opportunities being made available to CPGs. This regulation would allow the Board, through the Education Committee, to approve a course or activity for CEU credit without first receiving a CEU application from a sponsor.

The proposed addition of Continuing Education Regulation 205.6 was discussed by the Certified Professional Guardianship Board (CPGB) at the August 12, 2019 Board Meeting.

The proposed revision is as follows (added language is underlined and bolded):

205.6, "The Board may, on its own behalf, approve a course or activity for Continuing Education Credit without an application for Continuing Education Credit from an active Guardian or sponsoring agency. A continuing education activity approved under this subsection must be granted or denied in accordance with the provisions of Regulation 207. Neither a credit approval fee nor an attendance list will be required for a continuing education activity approved under this subsection 205.6.

205.6.1 A guardian who chooses to participate in a continuing education activity approved under this subsection must provide the AOC with a certificate of completion, or some other documentation which demonstrates the guardian's participation in the activity.

205.6.2 A guardian or other third party must provide an application for approval of continuing education activity in compliance with subsection 205.1 through 205.4 of this section and cannot request the Board approve a continuing education activity on its own behalf in lieu of the third party submitted the required application."

The Certified Professional Guardianship Board is proposing a revision to Continuing Education Regulation 204.6 and 203.2. These revisions are proposed in order to allow CEU course sponsors to have more flexibility in offering online and on demand CEU courses which could help ensure that all CPG's have access to enough CEU credits to timely meet their CEU reporting requirements. The proposed revisions are modeled after the CLE requirements set forth by the WSBA.

The proposed revision to Continuing Education Regulation 204.6 and 203.2 was discussed by the Certified Professional Guardianship Board (CPGB) at the June 10, 2019 Board Meeting.

The proposed revision is as follows (added language is underlined and bolded):

Regulation 203.2- A credit shall be awarded for each hour actually spent by an active Guardian or an inactive guardian who is planning to become active within the next 12 months in attendance at an approved education activity, provided that any pre-recorded audio/visual course, including online webinars, is less than five years old.

Regulation 204.6- No course will be approved which involves solely television viewing in the home or office or correspondence work or self-study. Video, motion picture, sound tape, or online presentations may be approved, provided they include a method of student-teacher interactive involvement.

The Certified Professional Guardianship Board is proposing a revision to Continuing Education Regulation 208.2.1. The revision is proposed in order to allow Certified Professional Guardians filing late Compliance Reports to complete CEU reporting requirements by taking classes offered in the new reporting cycle.

The proposed revision to Continuing Education Regulation 208.2.1 Late Compliance Report was discussed by the Certified Professional Guardianship Board (CPGB) at the March 11, 2019 Board Meeting.

The proposed revision is as follows (added language is underlined and bolded):

208.2.1 Late Compliance Report. Submitting by April 1 the affidavit called for by Regulation 208.1, the Affidavit Reporting CEUs, setting forth therein the extent of the active Guardian's compliance with the minimum education requirement. All continuing education activities submitted on the Late Compliance Report must have transpired either (a) during the two-year reporting cycle or (b) by March 31st immediately following the reporting cycle, with the exception of earned carry-forward credits as described in 202.3. Credits reported on the Late Compliance Report form under 208.2.1(b) may not be used to comply with the minimum education requirement for any other reporting period.

The Certified Professional Guardianship Board (Board) is significantly revising and reorganizing Disciplinary Regulation 500, which documents the Board's process to address alleged violations of statutes, fiduciary duties, standards of practice, rules, and regulations. The regulation review, revision and reorganization should result in a clearer, more comprehensive regulation.

The proposed revisions include the following:

Significant reorganization to achieve a logical order and flow.

Additional section headings.

Additional definitions.

Comprehensive explanation of roles and responsibilities.

Expanded explanation of procedural rules.

Expanded explanation of the investigative process.

Thoroughly defined grievance/complaint resolutions and sanctions.

The Board's Regulations Committee began reviewing the regulation more than five years ago. Initially, the Board planned an incremental review that included posting for comment proposed revisions in what was believed to be manageable segments. Part I was completed and approved for public comment June 10, 2013. It had a comment period that expired July 26, 2013. After hearing concerns regarding posting proposed revisions in parts, the Committee decided to honor a request from the Washington Association of Professional Guardians (WAPG) and complete a total review before seeking further comments. The total review is now complete.

Special Note

Significant revision, reorganization and renumbering, has made providing a document with the changes highlighted or underlined impossible. Such a document would not be readable. You are encouraged to proceed as though this were a new regulation. A side-by-side comparison of the current and proposed regulation is provided.

The Board planned to review, discuss and consider adopting proposed revisions in manageable segments over several board meetings; however, the Board reviewed the entire regulation during its June 12, 2017 board meeting. The Board approved several revisions to the Proposed Revision of Regulation 500. The approved revisions are provided in an attachment. The agenda for each of the next four meetings - August 14, September 11, October 16 and November 13 will include time to discuss Revised Regulation 500; however, if comments are not received, the Board does not anticipate needing further discussion.
