1998-4 Accelerating Review of Adult Sentences and Juvenile Dispositions

GENERAL ORDER 98-4 RESCINDING GENERAL ORDER 92-1 AND ACCELERATING REVIEW OF ADULT SENTENCES AND JUVENILE DISPOSITONS.

     In General Order No. 92-1, this court modified its procedures for reviewing adult sentences and juvenile offense dispositions. The court has determined to withdraw and replace General Order No. 92-1. Accordingly, it is hereby

     ORDERED that General Order No. 92-1 is withdrawn. In its place, it is hereby

     ORDERED that an appeal in which the only decision challenged is the propriety of the adult sentence will be reviewed according to RAP 18.15. If the brief of appellant indicates that the sentence is the only decision being appealed, and if a motion for accelerated review under RAP 18.15(b) has not previously been filed, then the court may accelerate review on its own motion. The court shall notify the parties of the schedule for perfecting and arguing the propriety of the adult sentence, pursuant to RAP 18.15. It is further

     ORDERED that an appeal in which the only decision challenged is the propriety of the disposition in a juvenile offense proceeding will be reviewed according to RAP 18.13. If the brief of appellant indicates that the disposition is the only decision being appealed, and if a motion for accelerated review under RAP 18.13(b) has not previously been filed, then the court will accelerate review on its own motion. The court shall notify the parties of the schedule for perfecting and arguing the propriety of the juvenile offense disposition, pursuant to RAP 18.13.
