General Orders of Division II

2003-1 Service of Verbatim Reports of Proceedings on Criminal Defendants

GENERAL ORDER 03-1
IN RE THE MATTER OF COURT ADMINISTRATION RE SERVICE OF VERBATIM REPORT OF PROCEEDINGS ON CRIMINAL DEFENDANTS

RAP 10.10 provides that if defendant/appellant requests a copy of the verbatim report of proceedings from defendant/appellant's counsel, counsel should promptly serve a copy of the verbatim report of proceedings on defendant/appellant and file proof of such service in the appellate court. To give effect to this new rule, which became effective on December 24, 2002, and to make it clear what the court considers a prompt response to defendant/appellant's request,

          IT IS ORDERED:

Defendant/Appellant's counsel shall serve a copy of the verbatim report of proceedings on defendant/appellant and file proof of such service in the appellate court within 10 days from the date the request is received. Counsel's failure to comply with the provisions of the Rule or this General Order will result in the imposition of sanctions under RAP 18.9.

ALTERNATIVELY, counsel may notify this court within 10 days of the receipt of defendant/appellant's request for the transcript and, upon notification, this court will arrange for the reproduction and service of the transcripts.
