SYNOPSIS: There are four issues in this case where one partner died intestate after a 28-year same-sex relationship and the surviving partner brought suit for an equitable share of their joint property. Whether on a summary judgment motion the trial court had enough evidence to determine the existence of a meretricious relationship, which property was joint property, and that all joint property should go to the surviving partner. Whether the equitable doctrine of meretricious relationships includes same-sex couples. Whether excluding same sex couples from the doctrine violates constitutional rights under equal rights and equal protection. Whether an award of attorney fees was proper without the full case being heard on the merits.
