SYNOPSIS: A no-fault motorist was injured in a car accident with an underinsured motorist. Her insurance company offset the amount of money owed to her under one type of coverage based on prior payments owed to her under another type of coverage. The motorist argues that because she had to pay attorneys in order to create the pool of money that allowed the insurance company to take the offset, the insurance company should pay a pro rata share of her attorney fees.
