The main issue is whether the city code renders Saddle Mountain’s minerals worthless. Also at issue is whether the surface owner’s right to have support for the surface land precludes mining and makes Saddle Mountain’s minerals worthless.

SYNOPSIS: In light of the 2000 census, Franklin County redrew the boundaries for its three commissioner districts. This court must decide whether the County's redistricting plan complied with the statutory requirements that each district be "as compact as possible" and that district boundaries, "to the extent possible, preserve existing communities."
