SYNOPSIS: This case requires the Supreme Court to determine whether, by agreeing at sentencing that their prior out-of-state convictions and/or federal convictions were properly included in their offender scores, these defendants waived their challenge on appeal of the sentencing courts’ decisions to include their prior out-of-state and/or federal convictions in their offender scores. The Supreme Court must also determine whether the 2002 amendments to RCW 9.94A.525(12) apply retroactively to reduce Legrone’s offender score.

SYNOPSIS: This case requires the Supreme Court to determine whether, by stipulating in his plea agreement that a prior conviction had not “washed out” and was properly included in his offender score, Lord waived his challenge that the sentencing court miscalculated his offender score when it included a “washed out” conviction. This case also requires the Supreme Court to determine whether the prosecutor breached the plea agreement when she revoked her recommendation that Lord receive Special Sex Offender Sentencing Alternative treatment instead of prison.
