SYNOPSIS: When a benefits recipient lives in the same household as his or her paid care provider, the Department of Social and Health Services (DSHS) applies the shared living rule which reduces the recipient’s hours of paid in-home care services. Does the shared living rule violate federal Medicaid laws, other federal laws, or the United States or Washington State Constitutions? Does the DSHS rule that prohibits an administrative law judge from invalidating a DSHS rule violate the Washington Administrative Procedure Act, or the United States or Washington State Constitutions?
