SYNOPSIS: Through a series of publications, Norman Le and other defendants accused Duc Tan and the Vietnamese Community of Thurston County (VCTC) of being under-cover Viet Cong agents and engaging in pro-communist activities. Plaintiffs argue defendants made false defamatory statements, not protected by the First Amendment, causing damages distinct from what would result from expressing the opinion that Tan and the VCTC are communists or communist sympathizers. Plaintiffs also claim that defendants made their statements with actual malice. Are they correct?
