SYNOPSIS: A jury awarded the plaintiff $12.75 million for injuries that her brother, Mark, sustained as a result of the City’s negligence. The City seeks a new trial on damages, arguing that it has surveillance video proving that Mark is not as injured as he claimed to be. Did the trial judge abuse her discretion when she excluded three of the City’s witnesses because they were disclosed after trial had already started, or when she denied the City’s motion for a new trial because she found it had not exercised “reasonable diligence” in investigating Mark’s physical condition?
