Call to Order:

Judge Hogan called the meeting to order.

Board Minutes:  The draft February 13, 2006 minutes were approved.

Chair Report:  Judge Hogan explained that she and the Chief Justice spoke about possible term limit requirements of members of the Board. She also spoke briefly about public information requests and informed the Board that approval of GR 23 by the En Banc Conference and the request for the appointment of a new Board member had been postponed until the April meeting.

Vice-Chair Report:  Commissioner Aronow shared that Shirley Bondon would send a request for topics for discussion during the retreat. He stated that the retreat would be a good forum to have a full discussion on the issues of insurance and financial responsibility.

The Board went into executive session.

The Board went back into open session.

Committee Reports:

Certification Committee - Discussed the option of obtaining federal fingerprint information for new applicants.  There would be an increase in fees from $30 to $54.  This fee increase would be passed on to new applicants.  Motion to approve was made and seconded.  Motion carried.  Approved.

Following is the list of applicants who were reviewed for certification as professional guardians and the disposition of their applications, pending receipt of clear background checks if not received to date.

Adagio Guardian Association – The Certification Committee recommended approval of certification.  Motion to approve was made and seconded.  Motion carried.  Certification Approved.

Elizabeth Bailey - The Certification Committee recommended denial of certification.  Motion to deny was made and seconded.  Motion carried.  Certification denied.

Geneva Baselt - The Certification Committee recommended approval of certification.  Motion to approve was made and seconded.  Motion carried.  Certification Approved.

Marlene Finch-Bridge – The Certification made no recommendation.  Motion to approve was made and seconded.   Motion carried.  Approved.

Sharla George - The Certification Committee recommended approval of certification.  Motion to approve was made and seconded.  Motion carried.  Certification Approved.

Grace Kittredge - The Certification Committee recommended approval of certification.  Motion to approve was made and seconded.  Motion carried.  Certification Approved.

Cynthia Rose - The Certification Committee recommended approval of certification.  Motion to approve was made and seconded.  Motion carried.  Certification Approved.

Erin E. Rycraft -  The Certification Committee recommended approval of certification.  Motion to approve was made and seconded.  Tom O’Brien abstained. Motion carried.  Certification Approved.

 

Robert Zielke - The Certification Committee recommended approval of certification.  Motion to approve was made and seconded.  Motion carried.  Certification Approved.

Michael L. Johnson - The Certification Committee recommended approval of request to change to inactive status.  Motion to approve was made and seconded.  Motion carried.  Approved.

The following list of guardians and agencies have requested voluntary decertification.  motion was made and seconded to grant voluntary decertification.  Motion carried.  Approved.

The following guardian failed to return to active status after the two years inactive period.  A motion was made and seconded to decertify this guardian.  Motion carried.  Approved

Sandra Martellini

SCOMIS was to be queried for each guardian decertified to determine if the guardian is still serving as guardian on any guardianship cases. Judges will be notified of the decertification of guardians and advised of the need to remove guardians if they are still serving as guardian on more than two cases in their respective counties.

When guardian agencies are decertified the AOC staff was instructed to verify the status of the designated guardians for the decertified agencies to ensure agency compliance with 2 CPGs.

Certification Committee: The Board decided to add language to the application consent for release that allows the Board to contact APS and CPS concerning each applicant’s history as it relates to abuse of a vulnerable child or adult. Suzanne Thompson Wininger and Robin Balsam agreed to edit the suggested language concerning abuse of a vulnerable adult that will be used in the application and annual disclosure. The purpose of the edit is to make the language more understandable by layperson.

Education Committee:  Many thanks were expressed to the Board members volunteering to serve during the mandatory training at the end of March.  The second mandatory training of the year will be held September 28 and 29, 2006.  Some discussion of mandatory training updates needs to be added to the retreat agenda.

There was discussion about a survey before and after the mandatory training. The purpose of the pre and post surveys is to quantify the reasons participants take the training but don’t apply for certification. The question concerning income levels will be removed from the pre-survey before distribution.

Continuing Education Regulation 205 was amended to encourage electronic submission of training materials.

Ethics Committee:  There was much discussion regarding proposed Regulation 117.  The comment period on the regulation was extended to May 10. The Board will discuss the regulation, perhaps even a revised version, during the retreat.

The Ethics Opinion on self-nomination, #2005-001, was discussed and approved with minor changes.

Public Information Committee:  The 2005 Annual Report is complete and has been distributed to the Supreme Court justices and Board members. 

Rules Committee: The Rules Committee will set a date to review rules and regulations.

Standards of Practice Committee:  Currently six panels have been appointed to review grievances that are pending.

The Board went into executive session.

Jana Hudson - The Appeals Panel recommended approval of certification.  Motion to approve was made and seconded.  Lori Peterson was absent for the executive session and open session vote.  Motion carried.  Certification Approved.
