Petition for Order for Protection (All Cases)

Paragraph 6, Identification of Respondent, a line for the respondent's "Race/Sex" was inserted after the line for "Date of Birth" and before the line for "Driver's License or Identicard." The new information was added to the form to conform JIS with the mandatory data entry requirements for the National Crime Information Center (NCIC) system. If all the mandatory data elements are not included, a protection order cannot be entered into the NCIC system and the ability to enforce protection orders in other states is impaired.

RCW 26.50.060 and .070 were amended by Ch. 119 Laws 2000 §§ 15 and 16 to authorize the court to provide the following relief:

Prohibit the respondent from knowingly coming within, or knowingly remaining within, a specified distance from a specified location.

The third and fifth requests for restraint provisions were modified to incorporate the new language:

EXCLUDE respondent from entering, knowingly coming within, or knowingly remaining within ____________________ (distance) of ¨ our shared residence ¨ any place I may reside. This address at present is

Temporary Order for Protection and Notice of Hearing (All Cases)

RCW 26.50.070 was amended by Ch. 119 Laws 2000 § 16 to authorize the court to provide the following relief:

Prohibit the respondent from knowingly coming within, or knowingly remaining within, a specified distance from a specified location.

The third and fifth restraint provisions were modified to incorporate the new language:

Respondent is EXCLUDED from going onto the grounds of, entering, knowingly coming within, or knowingly remaining within _________________________ (distance) of petitioner's residence. At present, petitioner's address is ¨ confidential ¨ the following:

Respondent is RESTRAINED from going onto the grounds of, entering, knowingly coming within, or knowingly remaining within __________________ (distance) of petitioner's ¨ school ¨ workplace

The "Warnings to the Respondent" box was updated as follows:

In the first paragraph, second line, after "criminal offense under chapter 26.50 RCW and before "and will subject a violator to arrest," the phrase "and RCW 10.31.100" was deleted.

The following phrase was inserted at the beginning of the paragraph that begins with "Any assault that is a violation": "Violation of this order is a gross misdemeanor unless one of the following conditions apply:" In the same paragraph, after "first degree or second degree under RCW 9A.36.011" and before "is a class C felony," the phrase "or 9A.36.021" was inserted. The following sentence was added to the end of the same paragraph: "Also, a violation of this order is a class C felony if the Respondent has at least 2 previous convictions for violating a protection order issued under Titles 10, 26, or 74 RCW.
