SUBJECT: CrR 4.2(g), JuCR 7.7 AND CrRLJ 4.2(g) GUILTY PLEA FORMS ADOPTED BY THE SUPREME COURT ON DECEMBER 2, 1999

The following is a summary of the changes made to the CrR 4.2(g), JuCR 7.7 and CrRLJ 4.2(g) guilty plea forms and adopted by the Supreme Court:

  1. CrR 4.2(g) guilty plea form:

    Paragraph 6[n]: The second to the last sentence in the paragraph beginning with "If I lack a fixed residence.." is changed to: "I must also report in person to the sheriff of the county where I am registered on a weekly basis if I have been classified as a risk level II or III, or on a monthly basis if I have been classified as a risk level I."

    Also in Paragraph 6(n), the one-sentence paragraph beginning with "If I move out of Washington State ." is deleted. The information provided in that paragraph duplicated the last sentence in the third paragraph in 6[n].

    Paragraph 6[r]: In the sixth line, the word "outpatient" is replaced with the words "substance abuse." The last sentence is revised to read: Additionally, the judge could prohibit me from using alcohol or controlled substances, require me to devote time to a specific employment or training, stay out of certain areas, pay thirty dollars per month to offset the cost of monitoring and require other conditions, including affirmative conditions.

    Paragraph 6 new subparagraph [ s ] A new paragraph [s] is added as follows: If the judge finds that I have a chemical dependency that has contributed to the offense, the judge may order me to participate in rehabilitative programs or otherwise to perform affirmative conduct reasonably related to the circumstances of the crime for which I am pleading guilty.

    The remaining subparagraphs in Paragraph 6 are renumbered.

  2. JuCR 7.7 guilty plea:

    Paragraph 12[C]: The second to the last sentence in the paragraph beginning with "If I lack a fixed residence.." is changed to: "I must also report in person to the sheriff of the county where I am registered on a weekly basis if I have been classified as a risk level II or III, or on a monthly basis if I have been classified as a risk level I."

    Also in Paragraph 12[C] the one sentence paragraph beginning with "If I move out of Washington State, ." is deleted. The information provided in that paragraph duplicated the last sentence in the third paragraph in 12[C].

    Paragraph 12[I]: The word "straining" in the fifth line is changed to "restraining."

  3. CrRLJ 4.2(g):

    Paragraph 6(l): The citation to RCW 9A.44 is corrected.

    Judge's findings: The following paragraph is added before the judge's signature line: "I find the defendant's plea of guilty to be knowingly, intelligently and voluntarily made. Defendant understands the charges and the consequences of the plea. There is a factual basis for the plea. The defendant is guilty as charged."

    Attachment "B": The citation to RCW 9A.44 is corrected.

    In Attachment "B," the second to the last sentence in the paragraph beginning with "If I lack a fixed residence.." is changed to: "I must also report in person to the sheriff of the county where I am registered on a weekly basis if I have been classified as a risk level II or III, or on a monthly basis if I have been classified as a risk level I."

    Also in Attachment "B," the one sentence paragraph beginning with "If I move out of Washington State, ." is deleted. The information provided in that paragraph duplicated the last sentence in the third paragraph in Attachment "B."
